In response to questions referred by the Juzgado de lo Mercantil No 1 of Pontevedra concerning a dispute between seven passengers and the carrier Air France, the Court clarified the meaning of ‘cancellation’ and ‘further compensation’.
Concerning the former (alltså: cancellation), the Court points out that a cancelled flight within the meaning of the Regulation is
the non-operation of a flight. For a flight to be considered to have been operated, it is
not enough that the aeroplane left in accordance with the scheduled itinerary. It
must also have reached its destination as appearing in the said itinerary. This is not the case where, as in the present proceedings,
the aeroplane took off but then returned to the airport of departure without having reached the destination.
The fact that the passengers were finally transported on another flight and the reason why the aeroplane was forced to return to the airport of departure are irrelevant to this classification. That reason is relevant only to determine, in the context of compensation for damage suffered by passengers due to the cancellation of their flight, whether that cancellation is possibly caused by ‘extraordinary circumstances’ within the meaning of the Regulation. In this case, the airline is not obliged to compensate the passengers.
