Den springande punkten är alltså inte hur sent du kom fram utan varför din flight blev inställd. Om SAS hävdar "extraordinära omständigheter" så kan du ifrågasätta vad dessa omständigheter bestod av. Var det ett tekniskt fel så omfattas det normalt inte av undantaget. Jag fick ersättning en gång när flighten ställdes in pga läckande noshjulsstyrning. Om det däremot beror på väder, flygsäkerhet eller strejk så är det en annan femma. Med flygsäkerhet menas alltså inte tekniska fel utan snarare bombhot eller liknande.

Den gången sa man faktiskt redan i gate på CPH att förseningen berodde på planerat tekniskt underhåll som dragit ut på tiden, tack för 600 Euro SAS!

Min flight ställdes pga att planet fått tekniskt fel i Oslo och tagits ur drift.
Tror att jag ska dra detta vidare för att få utrett vad som är korrekt.

Hjälper en vän med en claim mot Norwegian för ett försenat flyg ARN-LGW-BCN. I London blev planet mer än 3 h sent, och DY har redan accepterat ett claim på 250€. Borde vi ha rätt till 400€ enligt "final destination"-tänket som finns i t.ex. Air France v Folkerts tror ni? Eller finns det något annat case som passar bättre här?

SAS har accepterat att betala mig 75% av biljettpriset för en nedgradering HKG-ARN (PLUS till ekonomi) för några veckor sedan. Dock räknar de biljettpriset exkl skatter och avgifter vilket gör att det hamnar på mindre än hälften av vad jag faktiskt betalade för detta segment. Är detta verkligen rätt?

Det är nog rätt. Man kan tycka att de bör räkna in bränsletillägget åtminstone men det gör de inte.

    • arrive no more than two hours later than scheduled
  • the cancellation was caused by extraordinary circumstances that could not have been avoided by any reasonable measure.

Jag delar anjaks tolkning av regelverket, även om jag skulle rekommendera en mer vederhäftig källa än WIkipedia, t ex EUR-Lex - 32004R0261 - EN - EUR-Lex. I detta fall verkar Wikipedia stämma väl överens med artikel 5 i regelverket. Men de som hävdar att man alltid har rätt till kompensation vid inställt flyg får gärna hänvisa till den paragraf som stöder detta.

Article 5

Cancellation

1. In case of cancellation of a flight, the passengers concerned shall:

(a) be offered assistance by the operating air carrier in accordance with Article 8; and

(b) be offered assistance by the operating air carrier in accordance with Article 9(1)(a) and 9(2), as well as, in event of re-routing when the reasonably expected time of departure of the new flight is at least the day after the departure as it was planned for the cancelled flight, the assistance specified in Article 9(1)(b) and 9(1)(c); and

(c) have the right to compensation by the operating air carrier in accordance with Article 7, unless:

(i) they are informed of the cancellation at least two weeks before the scheduled time of departure; or

(ii) they are informed of the cancellation between two weeks and seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than two hours before the scheduled time of departure and to reach their final destination less than four hours after the scheduled time of arrival; or

(iii) they are informed of the cancellation less than seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than one hour before the scheduled time of departure and to reach their final destination less than two hours after the scheduled time of arrival.

2. When passengers are informed of the cancellation, an explanation shall be given concerning possible alternative transport.

3. An operating air carrier shall not be obliged to pay compensation in accordance with Article 7, if it can prove that the cancellation is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken.

4. The burden of proof concerning the questions as to whether and when the passenger has been informed of the cancellation of the flight shall rest with the operating air carrier.
