Jag ämnade söndag 10 november flyga hem till Stockholm från Buenos Aires via Amsterdam med KLM. Hem kom jag, men 18 timmar försenat.
Jag fick ett sms och mail från KLM redan tidigare under dagen (13:02) att min flight KL 708 skulle bli 1 timme försenad från 22:20 till 23:20. Väl på flygplatsen försenades flighten först 30 min till 23:50 för att sedan strax efter midnatt bli inställd sedan kaptenen på flygplanet kommit ut och mumlat något ohörbart åt oss. Det enda jag hörde var att de gjorde en genomgång av planet pga tekniskt problem. Ny förväntad avgångstid var istället 11 november kl 14:00.
Härifrån skötte sig KLM rätt bra, alla tog sig in i landet hyfsat smidigt och fick boende på Holiday Inn Ezeiza, tio minuter bort från flygplatsen. 10:00 lämnade vi i samlad trupp hotellet och åkte ut till flygplatsen, checkade in igen och flög schemaenligt 14:00 mot Amsterdam. Innan avfärd blev jag uppringd av KLM som meddelade mig att jag blivit ombokad till KL1109 från AMS-ARN, vilket också flög som det skulle och jag landade på Arlanda 12:30 nästan 18 timmar försenad.
Jag tyckte jag hade ett solklart case eftersom de hävdade tekniska problem på flygplanet som anledning till förseningen och skickade in ett krav på ersättning på 600 EUR. Fick dock (efter ett kort telefonsamtal där de meddelande samma sak och jag bad dem precisera i e-post) följande svar från KLM:
Dear EZE,
Thank you for your message to KLM which is dated 12th November 2013, and for taking the time to speak to me today. I am sorry to hear about the inconvenience you experienced on your recent journey on our services.
As discussed on the phone, I regret that no compensation can be offered according to EU Regulation 261/2004, as flight KL708 from Buenos Aires to Amsterdam on 10th November 2013 was delayed due to extraordinary circumstances. While we always do our best to avoid delays, I am sure that you can understand that lightning strikes are beyond the direct control of the airline and these are therefore considered to be extraordinary circumstances. When lightning strikes an airplane, inspections are necessary, which is why we had to postpone the departure of this flight until these had been carried out.
While I can assure you that we have got all the necessary documents to prove the reason for the delay, I regret to inform you that internal documents can only be requested by National Enforcement Bodies, and cannot be provided to the general public due to issues of confidentiality.
I would be pleased to arrange reimbursement of any expenses incurred during the delay, for accommodation, food and telecommunications. Please forward your receipts along with your bank details with IBAN and Bic codes using the link at the bottom of this email. Kindly also include your reference 6790819001 and my name in your reply.
In closing, we hope to see you soon again on our flights, when I trust that we will be able to serve you to your entire satisfaction.

Jag har återkommit och begärt in bevis på extraordinära omständigheter och fick nyss följande svar:
Dear EZE,
Thank you for your message to KLM which is dated 15th November 2013. We regret to learn that you remain dissatisfied with our previous replies.
As stated in our last email, we regret that only a national enforcement body such as Allmänna Reklamationsnämnden in Sweden can request internal documents such as technical logs. The EU Regulation 261/2004 does not as such state that these type of documents must be provided to the passenger. The delay was the result of a lightning strike which KLM could not have avoided even if all reasonable measures had been taken, and we therefore had to postpone departure until the necessary technical inspections had been carried out. While we can understand the inconvenience caused by this delay, we are sure that you can appreciate that the safety and security of our passengers and crew remains our top priority at all times.
As previously stated, we would be pleased to reimburse any expenses incurred during the delay.
In closing, we hope to see you soon again on our flights, when I trust that we will be able to serve you to your entire satisfaction.
